News – New 《Administration on Dangerous Chemical Registration》

《Administration on Dangerous Chemical Registration》is enacted, and is effective from August 1st, 2012. The previous Administration enacted on Oct. 8th of 2002 is abandoned the same time.

Key Points in English

1     Manufacturers and Importers of Hazardous Chemicals (hereafter ‘HC’) should register the HCs listed in <HC Catalogue> which are manufactured and imported by the Manufacturer/Importer. (remark by Randis: The <HC Cataloguey> new version is not published. It is expected the first batch of the Catalogueto be published earliest in April 2013. So the Administration is expected to be in operation then)

2     Newly established HC Manufacturers should make the registration before the final acceptance of the plant construction.

HC Importers should make the registration before the first import.

3   If a HC Manufacturer produces and imports the same HC, the manufacturer should make the registration as Manufacturer, and provide information of imported HC.

4    If a HC Importer imports same HC made by different HC manufacturers, the HC Importer should make the registration for the HC of the first import, and should provide information of the HC from the other HC manufacturers.

5    Registration Procedure:

5.1    The manufacturer/importer (hereafter ‘Registrant’) submit Application through Registration System.

5.2    The Registration Office examines the Application, and inform the Registrant to start the Registration after the examination is passed.

5.3    The Registrant provides information in the Registration System, and submit the hardcopies to the Registration Office.

5.4    The Registration Office examine the submitted materials, and make on-the-spot inspection if necessary. If the examination result is good, then the Registration Office submit the materials to National Registration Center.

5.5    The National Registration Center examine the received materials. If the examination result is good, then the Registration Certificate is issued to the Registrant.

6     Registration Materials:

6.1    HC Registration Form.

6.2    Business License of the HC Manufacturer, Qualification of HC Importers.

6.3    MSDS and Safety Label of the HCs, which should fulfill China National standards.

6.4    24hr Emergency telephone number, which should fulfill the requirements.

6.5    The HC’s quality specification (or standard code of corresponding China standards).

7     24hr Emergency telephone number requirement

7.1    By Full-time staff, 24hr on duty. The staff should be familiar with the HCs’ hazard properties and with the corresponding emergency measures, should be able to response precisely.

7.2    The staff should provide technical support and other necessary assistance, including: emergency measures for fires/explosions/leakage/toxication /suffocation/burn during manufacture/usage/storage/transportation of the HC.
