CFDA clarify the registration and management of whitening function cosmetics on April 11th, 2014, after having issued 2013 No 10 rule《about matters relevant to the regulation of administration of cosmetic products registration》on Dec.16th 2013.

I.         The scope identification of whitening.

If the cosmetics have advertised skin whitening function, the implementation of their administration should be executed strictly as the filing process of special use cosmetic products; if whitening (physical covering function) products made it clear that the skin whitening was included in it function are defined as special use cosmetic category, the examination and verification are consistent with the requirement of non-special use cosmetic products; If the products expressed or implied consumers that the mechanism of whitening action was though the way of physical covering, the examination and verification are consistent with the requirement of non-special use cosmetic products.

II.        The administration of promotion of whitening function.

The cosmetics only have cleansing and exfoliating functions are not allowed to use some words like “white” for the purpose of promotion and misleading consumers. At least when one product from the cosmetic series suit has whitening function, that suit can be sold with whitening function promotion, Otherwise some disguised advertisement like “whitening series” are not allowed to added..

III.       The filing system of whitening cosmetics.

The filing process administration of whitening cosmetics should be executed strictly as the one of special use cosmetic products. Whitening (physical covering function) products are defined as special use cosmetic category so that there is no need to submit Audit Opinion on Health Condition of Production in the process of application. The testing method and filing system of whitening (physical covering function) cosmetics are consistent with the one of non-special use cosmetic products, the same as the examination and verification. All samples will be sealed up for safekeeping by test authority directly.
