China State of Administration of Work Safety (SAWS) issued on December 3rd of 2012 at its website the draft version <Provisions on Identification and Classification of Chemicals’ Physical Hazards>.
This Provision may impose tremendous burden to chemical industry. Main content is summarized as below,
1 Application scope
1.1 Chemical producers and importers in China.
1.2 Chemical products for which the physical hazards are not confirmed yet.
1.3 A list of chemicals for which the Identification and Classification are not required will be issued.
2 Definition of Chemical products for which the physical hazards are not confirmed yet.
2.1 Chemicals already listed in <Catalogue of Hazardous Chemicals of China> (remark by Randis: not issued yet), but the new physical hazardous are found.
2.2 Chemical mixtures with more than one ingredients are listed in the <Catalogue>.
2.3 Chemicals not listed in the <Catalogue> yet, and the physical hazards are not identified.
2.4 Newly developed chemicals, which lacks of data on physical hazards.
3 Procedure
3.1 Chemical producer/importer submits application to Certified Institutes.
3.2 Identification (test reports) and classification results from the Certified Institutes should normally be issued within 20 working days.
3.3 Identification (tests) should normally include the 16 physical hazards as in GHS, as well as vapor pressure, self-ignition temperature, stability and reactivity, etc.
3.4 Identification and classification results should be submitted to NRCC for verification.
3.5 If the chemical product is classified as Hazardous Chemical, the SDS and Safety Label should be prepared, and the Hazardous Chemical should be registered to NRCC.
4 Penalty
If not to apply for the identification and classification, the company may face penalty of upto 10k RMB.
