‘Hazardous Chemicals Liable to Produce Explosives’ (LPE) first appeared in ‘Regulations on the Safe Management of Hazardous Chemicals’ enacted by China State Council as Order No. 591 in year 2011. The management requirements are addressed in this Regulations.

Requirement to Production and Storage:

Article 23 of the Regulations rules that ‘enterprises engaged in the production and storage of LPE shall record faithfully and accurately the quantity and whereabouts of LPE, and take necessary safety prevention measures to prevent LPE from losses and theft; when such losses or theft occurs, the local Public Security department shall be reported immediately. These enterprises shall set up Security guard mechanism and allocate full-time safeguard personnel’.

Article 24 and 26 rule that ‘LPE shall be stored in appropriative warehouse, and the appropriative warehouse shall be equipped with relevant technical prevention facilities in accordance with relevant national rules’.

Requirement to trading and purchasing:

Article 35 rules that ‘enterprises engaged in LPE trading shall apply for ‘Dangerous Chemicals Trading License’;

Article 40 rules that ‘enterprises engaged in production or trading LPE can sell LPE only to enterprises with certain certificates or statement for legitimate usage, and selling to individuals is forbidden’.

Article 41 rules that ‘the LPE selling enterprise shall record name and addresses of purchasing enterprise, names and identity card numbers of the person conducting the purchasing activity for the purchasing enterprise, as well as name, quantity and usage of the purchased LPE, and shall maintain these information s for at least 1 year. The selling and purchasing enterprise shall both report to local Public Security Bureau about name, quantity and whereabouts of the purchased LPE within 5 days of the purchase’.

Requirement to transportation:

Article 48 rules that ‘safety precaution shall be taken and report to local public security bureau shall be made for a relatively long time stop during transportation (e.g. for lodgment during transportation)’.

Requirement for accident measures:

Article 51 rules that ‘warning precautions and safety measures shall be taken and local public security bureau shall be reported for loss during transportation, theft, drainage or leakage of LPE’.
